Warranty
Do compatible filters void your air purifier warranty?
Short answer: no, not on their own — and by the time your first filter is due, there is usually very little warranty left to protect.
The short answer
In both Canada and the United States, a manufacturer generally cannot void your warranty simply because a compatible replacement part is fitted. To deny a claim, they have to show that the part actually caused the failure.
What the law actually says
United States
The Magnuson-Moss Warranty Act prohibits “tie-in sales” — a manufacturer cannot condition a warranty on using its own branded parts, unless it supplies those parts free of charge or holds a waiver from the Federal Trade Commission.
The FTC, which enforces the Act, has said plainly that it is generally illegal to void a warranty or deny coverage merely because an aftermarket part was used. It reaffirmed this in a 2021 policy statement on repair restrictions.
Canada
Canada gets to the same place by a different route. Tying a warranty to branded parts or manufacturer-only servicing is treated as an anti-competitive practice under the Competition Act.
Provincial implied warranties cannot be signed away by contract, and the right-to-repair framework holds that a warranty is not void because an independent part or repairer was used — provided that part or repair did not cause the damage being claimed.
The honest nuance: this is not a blanket immunity. If a replacement part genuinely causes a failure, a manufacturer can decline that claim — but the burden of showing it sits with them, not with you. That is the difference between “you used a compatible filter” and “this filter caused this fault.”
And then there is the timing
You buy the unit. The manufacturer warranty begins.
Surgically Clean Air’s warranty runs “12 months from the date of purchase”, per their own warranty page. It ends here.
Your first full filter change is due. HEPA and UV-C lamp run about a year; carbon is due by then at the latest.
Those two dates are the same date. The first time you actually have to choose between a genuine filter and a compatible one, the unit warranty has already run out. There is nothing left to preserve.
What each warranty actually covers
| Surgically Clean Air | Gem Filtration | |
|---|---|---|
| The unit | 12 months from purchase | We don’t sell units |
| The filters | Not covered — excluded as “consumable items” | Defective, damaged or wrong item — we replace it |
| Conditions on which parts you fit | “Official Surgically Clean Air replacements only” | None |
| Returns | Not stated for filters — they are excluded | 14 days, unused and in original packaging |
Read that middle row again. The manufacturer’s own warranty page excludes filters as consumables — so the genuine filter you are being told to buy in order to “stay covered” carries no warranty of its own. Ours does. Terms as published on surgicallycleanair.com, checked 10 August 2026.
What we stand behind
If a filter arrives damaged, is defective, or doesn’t fit the unit it was sold for, we replace it. Email hello@gemfiltration.com with your order number and a photo, and we’ll sort it out.
Unused filters in their original packaging can be returned within 14 days — full terms are on our returns page. What we don’t do is put a condition on which brand of filter you fit next, because nobody credibly can.
Common questions
Will using a compatible filter void my air purifier warranty?
Not by itself. Under the US Magnuson-Moss Warranty Act and, in Canada, the Competition Act together with provincial implied-warranty law, a manufacturer generally cannot void a warranty because a compatible part is fitted. They would have to demonstrate that the part caused the specific failure being claimed.
How long is the warranty on a Surgically Clean Air JADE?
Twelve months from purchase, per the manufacturer’s own warranty page. Since HEPA filters and UV-C lamps run about twelve months — and activated carbon is due by then at the latest — the first full replacement falls at roughly the moment that warranty ends.
What if the manufacturer says only genuine filters keep the unit covered?
Surgically Clean Air’s warranty page states that filters “must be changed on schedule using official Surgically Clean Air replacements only.” A condition of that kind is exactly what the US Magnuson-Moss Warranty Act’s tie-in provision addresses: a manufacturer cannot require its own branded parts as a condition of warranty unless it supplies them free of charge or holds an FTC waiver. A manufacturer is free to recommend its parts, and free to decline a claim it can show a third-party part caused — but not to void cover for the mere presence of one.
Are the genuine filters themselves under warranty?
No. Surgically Clean Air’s warranty page excludes filters as “consumable items” — so the genuine filter you are being told to buy in order to stay covered carries no cover of its own.
What happens if a Gem filter is faulty or doesn’t fit?
We replace it. Email hello@gemfiltration.com with your order number and a photo. Unused filters in original packaging can also be returned within 14 days under our standard returns policy.
Do I need to keep proof of replacement?
Keep your order confirmations either way. If a manufacturer ever questions a claim, dated records of what was fitted and when are the most useful thing you can have — whoever made the filter.
